This document outlines the warranty terms and conditions for GOOVIS products purchased by consumers within the European Union (EU). This policy is designed to comply with applicable EU consumer protection legislation, including the Consumer Rights Directive (2011/83/EU) and the Directive on certain aspects concerning contracts for the sale of goods (2019/771/EU).
As a consumer in the EU, you benefit from a legal guarantee of conformity (often referred to as a "statutory warranty") for a period of two (2) years from the date of delivery of your GOOVIS product. This guarantee ensures that the goods delivered are in conformity with the sales contract.
A product is considered to be in conformity if it:
· Matches the description provided by GOOVIS and possesses the qualities of the sample or model shown to you.
· Is fit for the particular purpose for which you require it and which you made known to GOOVIS at the time of purchase, and which GOOVIS has accepted.
· Is fit for the purposes for which goods of the same type are normally used.
· Shows the quality and performance which are normal in goods of the same type and which you can reasonably expect, given the nature of the goods and taking into account any public statements on the specific ch1aracteristics of the goods made by GOOVIS, the producer, or their representative, particularly in advertising or on labelling.
For a defect that becomes apparent within one (1) year from the time of delivery, it is presumed that the defect existed at the time of delivery, unless GOOVIS can prove otherwise or this presumption is incompatible with the nature of the goods or the nature of the non-conformity. After this one-year period, you may need to provide proof that the defect existed at the time of delivery.
If a GOOVIS product does not conform to the sales contract, you have the right to:
1. Repair or Replacement: In the first instance, you can choose to have the goods repaired or replaced, free of charge, unless your chosen remedy is impossible or disproportionately expensive compared to the other remedy. GOOVIS must carry out the repair or replacement within a reasonable time and without any significant inconvenience to you.
2. Price Reduction or Termination of Contract (Refund): You are entitled to a proportionate reduction in the price or to terminate the contract (and receive a full refund) if:
a. GOOVIS has not completed the repair or replacement within a reasonable time, or has not done so without significant inconvenience.
b. The non-conformity reappears despite GOOVIS having attempted to bring the goods into conformity.
c. The non-conformity is of such a serious nature as to justify an immediate price reduction or termination of the contract.
d. GOOVIS has declared, or it is clear from the circumstances, that they will not bring the goods into conformity within a reasonable time or without significant inconvenience.
You cannot terminate the contract if the non-conformity is minor.
In addition to your statutory rights under the legal guarantee of conformity, GOOVIS may offer a separate commercial warranty (often referred to as a "manufacturer's warranty"). This commercial warranty is additional and does not affect your legal rights under the 2-year legal guarantee.
Any commercial warranty offered by GOOVIS will be clearly stated, including its duration, scope, and the terms for making a claim. Typically, a commercial warranty against defects in materials and workmanship would be for one (1) year from the original date of purchase, unless explicitly stated otherwise by GOOVIS for specific products or promotions. Details of any such commercial warranty will be provided with your product.
Neither the legal guarantee nor any commercial warranty covers:
· Normal wear and tear of the product.
· Cosmetic damage, including but not limited to scratches, dents, and broken plastic on ports, unless such damage is a result of a defect in materials or workmanship present at the time of delivery.
· Damage caused by misuse, abuse, negligence, unauthorized modification, or accident (e.g., drops, liquid damage, fire, or other external causes).
· Damage caused by operating the product outside the permitted or intended uses described by GOOVIS.
· Damage caused by service performed by anyone who is not an authorized representative of GOOVIS.
· Products with a tampered or missing serial number.
· Consumable parts, such as batteries, unless their failure is due to a defect in materials or workmanship existing at the time of delivery.
· Software issues, including data loss, unless directly caused by a hardware defect existing at the time of delivery.
If you believe your GOOVIS product has a non-conformity or defect, please follow these steps:
1. Contact GOOVIS Support: Immediately contact GOOVIS customer support via [GOOVIS Website/Email/Phone Number - Insert specific EU-friendly contact method here]. Clearly describe the issue you're experiencing. Our support team may be able to troubleshoot and resolve the problem remotely.
2. Provide Proof of Purchase: You will need to provide valid proof of purchase (e.g., original receipt, invoice, or order confirmation) that clearly shows the date of purchase and the product description. This is essential for verifying your statutory rights.
3. Return Authorization (RMA): If the issue cannot be resolved remotely, GOOVIS will provide you with a Return Merchandise Authorization (RMA) number and instructions for returning the product to an authorized service center.
4. Packaging and Shipping: Package the product securely, ideally in its original packaging. Clearly mark the RMA number on the outside of the package. You are not required to bear the cost of returning goods that are non-conforming. GOOVIS will cover the cost of shipping the non-conforming product back to us or an authorized service center, and for returning the repaired or replaced product to you, provided the claim is valid.
· GOOVIS reserves the right to use new or refurbished parts for repairs, or to replace a product with a new or refurbished product of equivalent functionality.
· Repaired or replaced products will be covered by the remainder of the original 2-year legal guarantee period. If this remainder is less than six months, the repaired or replaced product will benefit from a new 6-month legal guarantee.
Except as provided in this warranty and to the maximum extent permitted by EU law, GOOVIS is not responsible for direct, special, incidental, or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage whatsoever caused, including the replacement of equipment and property.
This policy outlines your rights under EU consumer law. This warranty does not affect any statutory rights that cannot be waived or limited by contract. This policy is governed by the laws of the EU member state where you, as the consumer, habitually reside, without regard to its conflict of law principles.
